Mandatory annual communication to the Companies Trade Union Representatives (RSA)

This to inform you that, within January 31st 2023, every Company which employed, during 2022, some temporary workers, will be obliged to submit a mandatory annual communication to the Companies Trade Union Representatives (RSA) or to the Unitary Trade Union (RSU) or, in case of lack, to the local relevant Trade Unions offices, the most representative on national level in the Company economic sector, detailing the temporary employments contracts data signed in 2022.

 

The essential mandatory information, to be indicated on the attached form are:

  • the number of temporary employments contracts activated;
  • the duration of said contracts;
  • the number and the qualification of workers

 

The reference period is year 2022 and the communication should not show the name of the temporary workers, but only the numerical data.

 

The submission can be accomplished:

  • by hand;
  • by registered mail with return receipt;
  • by certified email (PEC).

 

As an ordinary procedure, temporary work agencies provide such information to every Company.

 

Lastly, we remind you that the current law provisions (included as of art. 40, par. 1, Legislative Decree no. 81/2015) establish a pecuniary administrative fine to be calculated in a variable measure, from 250 EUR up to 1.250 EUR, in case of missing communication or improper fulfillment of the form.
