Correction of Accounting Errors: New Tax Rules Starting in 2025 – TAX INSIGHTS DECEMBER 2025

With the entry into force of Legislative Decree 192/2025, published in the Official Gazette on December 20, the tax treatment of accounting error corrections undergoes significant changes. The new provisions apply to adjustments made in financial statements under OIC 29 and IAS 8, introducing stricter limits compared to previous rules.

What Changes in 2025

From the next fiscal year, immediate tax recognition of corrections will only be possible under two key conditions:

1. Shorter Timeframe

The error must have occurred in the previous fiscal year. In practice, the 2025 financial statements can automatically correct only errors from 2024. For irregularities dating back to 2023 or earlier, companies will need to revert to the system of amended tax returns.

2. Non-Material Errors Only

Automatic tax recognition applies exclusively to corrections of errors deemed “non-material” under accounting standards. Materiality depends not only on the amount but also on the nature of the error and its impact on stakeholders’ decisions. This subjective assessment could lead to disputes with tax authorities. The role of the statutory auditor will therefore be crucial in supporting the classification of the error.

Who Is Eligible

The automatic mechanism is reserved for corporate income taxpayers (IRES) whose financial statements are subject to statutory audit, even if prepared in micro format (Art. 2435-ter of the Civil Code). Until 2024, the so-called “enhanced derivation” was required—this is no longer the case.

Additional Restrictions

· Tax effectiveness is excluded if the correction occurs after the start of a tax audit on the items concerned.

· For IRAP, in addition to the conditions for IRES, the net production value must be positive both in the year the error occurred and in the year of correction.

In Summary

Starting in 2025, the tax regime for correcting accounting errors becomes more restrictive: tighter deadlines, quantitative limits, and greater scrutiny of error classification. Companies will need to plan adjustments carefully to avoid complications and disputes.
