Credits-Based License System

From October 1, 2024.
Scope of Application:
All individuals operating in construction sites, defined as “any location where building or civil engineering works are carried out,” must hold a credits-based license. The only exceptions are those providing only supplies, individuals performing intellectual activities, and companies holding a SOA qualification certificate of class III or higher.
Requirements:
- Registration with the Chamber of Commerce, Industry, Handicraft, and Agriculture;
- Fulfillment by employers, managers, supervisors, self-employed workers, and employees of the training obligations provided by this decree;
- Possession of a valid Unified Contribution Compliance Certificate (DURC);
- Possession of a risk assessment document, where required by current regulations;
- Possession of a valid fiscal compliance certificate as per Article 17-bis, paragraphs 5 and 6, of Legislative Decree no. 241 of July 9, 1997, where required by current regulations;
- Appointment of a responsible person for the prevention and protection service, where required by current regulations.
Summary:
Starting from October 1, 2024, work activities at construction sites are permitted only for companies and self-employed workers who possess a credits-based license. The governing regulation is contained in Article 29 of Decree-Law 19/2024, converted into Law no. 56/2024, which amended Article 27 of Legislative Decree no. 81/2008.
Decree no. 132/2024 implements these provisions, delegating the National Labor Inspectorate (INL) to define the application aspects related to the issuance and management of the license. Pursuant to this delegation, the INL issued Circular no. 4 on September 23, 2024. Prior to the implementation of the digital platform for applying for the credits-based license – available from October 1, 2024 – an affidavit/self-declaration regarding compliance with the requirements may be submitted. This self-declaration is valid until October 31, 2024, and must be sent via certified email (PEC) by that date.
From October 1, 2024, all individuals working in construction sites, defined as “any location where building or civil engineering works are carried out,” are required to have a credits-based license. Exceptions include those solely providing supplies, individuals engaged in intellectual work, and companies holding a SOA qualification certificate of class III or higher.
The license is issued in digital format through the National Labor Inspectorate (INL) portal, accessible from October 1 using SPID or CIE credentials. The application for the license can be submitted by the legal representative of the company or by a self-employed worker, either directly or through an authorized representative, including professionals listed under Article 1 of Law no. 12 of January 11, 1979.
An affidavit/self-declaration regarding the possession of the requirements as specified in Article 27, paragraph 1, of Legislative Decree no. 81/2008 may also be submitted. Companies concerned may continue or commence activities requiring the credits-based license starting from October 1
The requirements for obtaining the license, as indicated in paragraph 1 of Article 27 of Legislative Decree no. 81/2008—also known as the Consolidated Workplace Safety Act—are:
- Registration with the Chamber of Commerce, Industry, Handicraft, and Agriculture;
- Compliance by employers, managers, supervisors, self-employed workers, and employees with the training obligations provided in this decree;
- Possession of a valid Unified Contribution Compliance Certificate (DURC);
- Possession of a risk assessment document, as required by applicable regulations;
- Possession of a valid fiscal compliance certificate as per Article 17-bis, paragraphs 5 and 6, of Legislative Decree no. 241 of July 9, 1997, as required by applicable regulations;
- Appointment of a responsible person for the prevention and protection service, as required by applicable regulations.
